YESTERDAY'S EVIDENCE.

After our report of the bearing of the Greenfield bankruptcy petition had closed yesterday,

Mr. Zeitlyn, in reply to the Judge, intimated that be relied mainly on the illegality of gambling debts.

Mr. Alabaster: We contend this is not a gambling transaction at all, but that the brokers took instructions to sell sharra and actually did so. We contend that Mr. Greenfield led them to believe-in fact, he told Mr. Razeek-that he could eell for cash; which implied that he had the shares, but preferred to sell forward because be would get a better price. He told Mr. Carvalho, clerk to Mr. Silva, that he had the shares and, at a later date, actually showed him what purported to be scrip.

Mr. P. M. N. da Silva, giving evi decce in support of the petition, said

that on June 16, Mr. Greenfield en tered into a contract to sell 1,003) shares in the China Provident Com. pany Ltd., for $11.60 per share for September delivery. On the same day he witness) entered into a con tract with someone else to purchase the shares at that price. The witness indicated that the contract notes bore the same serial numbers, which meant that the asras black of shares was re- ferred to, both in the transaction of buying and selling. On the 2nd June Mr. Greenfield sold another thousand at $11.90 and there were also resold On July 27, he wrote to, the debtor, asking bim to pay $8.500 cash within 48 hours in pursuance of Bye law VI., which appeared on the back of the contract, the stock having appreciated 35 per cent. to $17.50.
