Senators Lodge and Underwood, both members of the American delega tion, asuured the Senate there was nothing to conesal, Senator Underwood explained that a great part of the negotiatione concerning the abrogation of the Anglo-Japanese alliance would not be found in the minutes as the subject was mostly discussed in normal conversation.
Replying to Saator fitchcock's remark that the Senate and Hase of Representatives seemed to have boon on the outsid while the four-power pack was worked out. Senator Lodge said that thr versations were be- tween the heads of the delegations as that was the spiest way of dealing with so delicate a situation but the treaty was fully discussed by the American delegates long before it was submitted to the other delogations.

The amount claimed was $542.56. The defence was that on the eve of Chinese New Year there was informal meeting of the defendant's creditors at which he announced that he had no funds but had managed to borrow $2,000 out of which he proposed pay Jus creditore about 20% of the amount of their claims, aggregating roughly $10,000, if they would agree to take it in full satisfaction. Ho indicated that it this offer WDS refused he would file bis petition in bankruptcy. At first the offer was not accepted and there were many complaints but finally all exnupt one creditor agreed to the arrangement. Amongst those who

His Honour observed that there WAR a certain conflict of evidence which, on the main points, he was prepared to decide in the defendant'. favour A point taken by Mr. Russ (plaintiff's solicitor) in " his very able argument" was that unless every creditor como in, the composi tion failed. His Honour after discussing cases quoted on the point, held that in the present in- Blance all the creditors but one agreed in the end and there was thus ample consideration for the agreement. On the gvidence moreover it was clear that those creditors who accepted pay- ment and signed the receipt knew when they did so that two of their number declined to come in.
Referring to certain other points which had cropped up His Honour declared that there was no taint of fraud for he was quite satisfied that every creditor understood what was being done and acquiesced in it.
