1. The object of this Ordinance is to make it clear that in resumptions under the Crown Landa Resumptions Ordinances no compensation is to be awarded in respect of mere expectan- cies or probabilities. For example, Huichow, (B. & S.) from Hongay.- the owner of agricultural land | B.28. held under a Crown lease which Kueichow, (B. & S.) from Canton. prohibits the erection of buildings - 44. except with the licence of the Crown is not to receive any compensation with respect to the possibility that such a licence might at some time have been obtained if the land had Lot been resumed. This principle is not new as it is in force under the Lands Clauses Consolidation Acts in England, and it seems only reasonable that the community should not have to pay for a mere possibility of this kind which the claimant could never have enforced.
2. The reason for the amendment of Ordinance No. 14 of 1921 on this point is that that Ordinance laid down as a general rule that the basis of compensation should be the market value of the land, and it appears to be the case that speculators, in the case of agricultural land for instance, are often prepared to pay more than the value of the land for agricultural purposes in the hope that they may be allowed to
¿ convert it into building land. The claimant in such a case would no doubt argue that the speculator's price formed or was evidence of market price above. the real value of the land as agricultural land. This position is all the more likely to arise in a district which is, sbout to be developed by the Govera ment for building purposes, and if the above argument were to prevail the Tesult would be that the community would have pay
much increased price for the land, although this! increased price was Ensed solely on the mere possibility of conversion which the Government na ve kuruluto

discretion to refuse. The effect would be to make development more expen- ive and to raise the rente on the developed property, and it might even have the effect of checking develop mént altogether in a particular district.
3. The intention of this bill, there- fore, is to provide that the rule of taking the market price as the basis of compensation is to be subject to the further rule that no compensation in to be given in respect of such mere probabilities.
For convenience, the whole of
section 2 of Ordinance No. 14 of 1921
is to be repealed and re-enacted, but praocally the only part of the sub stituted section which is new is paragraph (0),

AN INCORRECT MANIFEST.
Captain Murr of the 5,8,Wingon" was charged before Magistrate Wood yesterday afternoon with having failed to render a correct manifest to the Imports and Exports Office showing the amount of dutiable goods carried intu port by his vessel.
Mr. N.L. Smith, Superintendent of Imports and Exports prosecuted and produced Chief Preventive Officer Wait to prove that the manifest tendered to the Imports and Exports Office was incorrect.
Mr. M. K. Lo, defending, admitted that the manifest was incorrect by inadvertence, but contended that a corrected manifest had been tendered within the time limit allowed by regulations.
The 'manifest which was tendered at 7.a.m., on Sunday, soon after the ship's arrival, did not include two cases of tobacco which Inspector Watt found on board when ho visited the ship an hour later.

BUILDER'S FATAL FALL
While working in a new building nearing completion in Temple Street, Yaumati, yesterday afternoon, & mason accidentally fell through an opening in the first floor and received severe injuries to his head, from which he died at the Kwong Wab Hospital a couple of hours later.
FIRE BRIGADE BUSY.
Sparks set fire to the roof of the workshop of the Tung Tok tin smelting firm at No. 420 Queen's Road West at 2.05 this morning. The Brigade turned out promptly and averted a big blaze. Damage was caused to the extent of $50.
