The first arose on an action for divorce brought by a Dresden officer, who alleged that his wife, married by him during the war, had represented herself to be ten years younger than she actually was.

The judge said that since women made themselves out to be younger than they actually were, the law should take a lenient view of the practice. He added that the habit among civilised men to marry women younger than themselves was in theory sound, because women aged more rapidly than men, so that, since age often signified loss of physical charm, it was well that there should generally be a substantial difference in years between the parties.
