vi(Continual: from Fage (3.) Good man do "you"danatly carry Candies on this ship?" The engineer replied

Treska wimbes A asked When we are on with our+repairs, What are we going to do tordlight?”

The same as we didin-Kobar”. We'll use candicTM was the 'ëngineer's reply! Wimese asted the chiet engi- neer to remember that answer as be did not like the place in which candles were being used. Candles were used in the engine room all the time the ship was in dock and witness say the chief engineer using candles, repeat- edtyEvery day wimes was. caul~ rioning the chief engineer, over the use of candles.

-

Re-examined by Mr. Fartopp Ho never gave the. Etters, instructions with regard to the work done on the en gines. That was looked after by the chief engitear. There were hom 80 to 100 tons of fuel oil on board and also some kerosent. It was not until during the firo that he knew there was It also gasolene in the engine room. was about..two hours aher the fire started and seemed to be under co- trol, when the firemen were about (9 zo down below with smoke helmets. on, when, he was told the, there vis gasolone down below, upon which to made a report of the matter to Mr. Peit the Chiet Officer of the Firs Brigade. In order that the Bremen hould not endanger their lives. It was true that the auiliary dynams had not been pulled when the ship was taken cut dry dock, but thre fixtures, had been put in place and the dynamb itself was on the ship ready to be set up when the ship was at ter buoy.

When witness left the ship the night before the fire the men, vere at their food. He did not knoW WALL happened after that except from hear- say. Witness signed for all the men employed by the International Back, but he did not sign for the twe watchmen nor was there any baf passed by him containing tha: Herm. While the Dook Company might get watchmen for a ship they would not be employed by the dock but by the ship.

In answer to Mr. Hartopp :-It was not a standing rule of the Deck Company that they would not allow any, workmen to be employed sim ship other than their own servants.

Mr. F. W. Henderson in charg of Messrs. Jardine, Mathoson & Co.'s motorworks, said the use of asked fights in an all-driven vessel com structed of wood was distinctly" dan- gerous. The presence of gasolene in such an engine room would always be dangerous. Gasolene would. - ways be expected to be on a vessel when it was in operation..

Cross-examined was usual to keep gasolene in.a tsok in a cagion

Mr. Hartopp submitted that the employees of the defendants and they alone were in the engine room on November 14, when the fire broko put. He urged that the circumstances of exactly how the fire broke out could only be explained by the defendants or their servants. Unless they could so explain and show they were not

to judgment. The asse consequently reduced itself to one question; wes ec. was it not a negligent tüng to use a naked light in the engine room of a wooden motor vessel propelled by oil The fact that the chief engineer allowed candies to be used was ne earthly reason for the defendants allowing their employees to do so, and if, as a result, fire broke out the defendants were responsible.
