no doubt, depend on the decision of Her Majesty's Government as to whe ther or not thay alial be handed over to the Chinese suthorities. They have. bean osomiged at the Police Court on a charge of murder and robbery on the mainland, brought against them by the Chinese officials, who apply for their extradition. It is a fact, proved by the evidence for the prosecution, that they were leaders in the recent disturbances in the Wei-chau department disturb ances which were generally regarded to in Hongkong us a rebellion. The de mand for their extradition is based op the 21st arbale of the Tippisin Treaty of 1858, which provides: If criminals, subjects of Chins, thall take refuge in Hongkong, or on board the British ships there, they shall, upon due requi- aition by the Chinese authorities, be searched for, and on proof of their guilt, bo delivered up. This article besto interpreted by the Extradi- tion Act. In no case does one state surrender to another persone whorn offences are of a political character, and the act settles tlio origes for which ex- tradition is allowed, namely, murder, manslaughter, coining, forgery, larceny, false pretences, bankruptcy offences, rape, bination, child-stealing, bargia- Tarson, robbery, threats to extort money sinking of ships, and many and assault-in ships
It is quite clear, therefore, from what we liave just stated, that the British Government would not be justified in surrenderingthese two men if it appeared that the thinese Government applied for their extradition with the object of punishing them for taking part in a rebellious rising on the mainland, or as active members of a political associa- tion like the Trind Society, The anxiety of the Chinese authorities to get hold of these two men is indicated by the circumstance that two local inwgeTS were engaged in preparing the case against them and in working it at the Court, Mr Cressy Ewens representing the Chinese Government, and Mr Wotton, of Messrs Brereton, Dencon and Wotton, representing General Tang, On the other hand, the two wretched, ignor- aat prisoners had no legal assistance in their defence. A correspondent called, attention to this circumstance in a letter we published a day or twvc pgo, and wa must confess we do pót understand why. the Government did not afford the prí- soners some legal aid, considering their ignorance and the importance of the finestion raised for decision by the Government,
