5. The Immigration Officer shall prior to the Twenty-fifth day of January One thou- sand nine hundred and forty one give the General Agent a list of all existing agencies which have signified their desire to re-open under the new agency scheme on the said Twenty-fifth day of January One thousand nine hundred and forty one together with a list of all approved addresses.

6. The General Agent shall prior to the Twenty-fifth day of January One thousand nine hundred and forty one, visit or cause to be visited all such premises as are referred to in paragraph Five, and shall where the size and nature of the premises permit establish in each a photographic studio; provided that wherever it is found that any two or more such premises are nearer together than appears to the Immigration Officer necessary for the convenience of the public, the Immigration Officer may refuse further recognition of one or more of them, and the General Agent shall no longer be obliged to provide a photographic studio in those premises.

If any such premises are found to be unsuitable for the purpose of a photographic studio, the General Agent shall at once report the fact in writing to the Immigration Officer for further directions.

8. In submitting completed applications to the Immigration Officer for approval the General Agent shall conform with the existing practice followed by agencies as well as with any directions which may be given from time to time by the Immigration Officer.

9. The General Agent shall be entitled to charge Forty Cents for each pair of passport-type photographs required as aforesaid and this price shall not be increased without the sanction in writing of the Immigration Officer. For supplying the appro- priate application form, completing it, translating where necessary and submission of the complete application form to the Immigration Officer paying for and taking delivery of the completed documents and delivering them to the several applicants he shall be entitled to charge One Dollar per applicant and this fee shall include supplying a pair of passport-type photographs as aforesaid but shall be chargeable whether or not such This fee shall not be either photographs have been supplied by the General Agent.

IO. The General Agent shall establish and maintain at any suitable places within the Colony of Hong Kong or its dependencies specified by the Immigration Officer facilities for photographic work and all such work as is detailed in Clause One hereof, such establishments to be in operation within one week of receipt of directions to that effect from the Immigration Officer, and the General Agent shall not close any agency or reduce any such facilities now in existence without the prior sanction in writing of the Immigration Officer.

II. The General Agent shall remunerate all persons employed by him after the said Twenty-fifth day of January One thousand nine hundred and forty one for the purposes of this Agreement by means of a regular monthly wage and not otherwise such wage to be paid in full on the last working day of each month.

12. The General Agent shall observe the new conditions of the recognition of agencies a copy of which is annexed hereto and shall at once report fully in writing to the Immigration Officer any failure on the part of any agency to observe such condi- tions and shall if required to do so by the Immigration Officer assist in obtaining further information regarding such failure and placing the information so obtained at the disposal of the Immigration Officer.

13. All moneys received by the General Agent under the terms hereof shall be lodged by him with the Bank before 3 p.m. on working days and 12 noon on Saturdays and the agencies shall be instructed that no money will be accepted later than 2 p.m. on working days or after 11 a.m. on Saturdays.

14. The General Agent shall employ a firm of auditors approved in writing by the Immigration Officer for the purpose of auditing the books kept by the General Agent under the terms hereof at such intervals as may be required by the Immigration Officer and all cheques drawn by the General Agent on the banking account kept under the terms of Clause Four hereof shall be countersigned by such firm of accountants.
