for safe custody until an opportunity occurs of return- ing him to the country of his birth or citizenship or to his port of embarkation.

(5) In any case in which an alien has been refused a landing permit the master of the ship on which such alien arrived in the Colony shall, upon the order of the Immigration Officer, be bound to re-embark such alien upon his ship, and if such ship shall have left the port of disembarkation before such alien shall have re-em- barked thereon, the master, owner, charterer and agent of such ship shall be jointly and severally liable to pay to the Immigration Officer all costs and charges incur- red by him in respect of the maintenance of such alien and his return to his country of birth or citizenship or his port of embarkation :

Provided that no alien who has lodged an appeal under subsection (3) shall be re-embarked or otherwise removed from the Colony without his consent until a decision on the appeal has been received from the Local Authority;

Provided further that if the landing fee has already been paid such fee shall be refunded.

20. (1) The Immigration Officer may at his discre- with attend- tion, instead of ordering an alien to proceed to a depôt

(a) issue to such alien, on payment of the landing fee, a landing permit in the prescribed form and permit him to land forthwith; or (b) permit such alien to land forthwith,

after

taking such security as he may deem fit that such alien shall attend, within such time as the Immigration Officer may direct, at some proper place to pay the landing fee and apply for a landing permit.

(2) If any alien who has been permitted to land under subsection (1) (b) shall fail to attend at the appointed place within the time directed as aforesaid, such security as has been given shall be estreated and such alien shall be deemed to have contravened the provisions of this Ordinance :

Provided that the costs and charges of returning such alien to his country of birth or citizenship or his port of embarkation shall not be chargeable against the
