ENCLOSURE II.

His Majesty's Government in the United

Kingdom being desirous at this time of further effectuating the declarations made on its behalf by His Excellency The Right Honorable The Marquess of Lothian, C.H., British Ambassador Extraordinary and Plenipotentiary, in his communication of 2nd September, 1940, to the Government of the United States of America, a copy of which is hereto appended and made a part hereof, agree that in respect of the naval and air bases leased to the United States of America by the Governments of Newfoundland, Bermuda, Jamaica, St. Lucia, Antigua, Trinidad and British Guiana by leases forthwith to be executed in the form and terms of the copies hereof, hereto appended and approved, and made a part hereof, the United States of America shall have all the rights, power and authority within the bases so leased and within the limits of territorial waters and air spaces adjacent to or in the vicinity of such bases which are necessary or appropriate to provide for the establishment, use, operation and access to and for the defense and control of such bases.

Without prejudice to the above mentioned rights, the United States of America agrees that in respect of the power granted to it over the territorial waters and air spaces adjacent to or in the vicinity of such bases it will not use such power unreasonably or so as unnecessarily to interfere with the rights of sea navigation to or from the ports, or aviation to or from and within the respective Territories.

Subject to the foregoing paragraph, the said rights, power and authority shall include inter alia the right, power and authority to:

Construct (including dredging and filling) maintain, operate, use, occupy and control said bases;

to improve and deepen the harbors, channels- entrances and anchorages, and generally to fit the premises for use as naval and air bases;

(c) to control anchorages, moorings and

movements of ships and water borne craft and the anchorage, moorings, landings, take-offs, movements and operations of aircraft;

(a)

to regulate and control all communications within, to and from the areas leased;

(e) to instal, maintain, use and operate

breakwaters, under sea and other defenses, defense devices and controls, including detecting, and other similar facilities; and including specifically with respect to Bermuda in the entrances to Castle Harbor;
