(3.) By provisional scheme sanctioned by Parliament authorise a A.D. 1886.

public company or any person or body of persons to undertake the supply of gas, light, heat, or motive power.

Provided that—

(a.) Nothing in this section shall authorise any gas or water works to be constructed within the limits of supply of any or gas water company empowered by Act of Parliament or any order confirmed by Act of Parliament to supply gas or water, if and so long as any such company or person are able and willing to supply gas or water proper and suficient for all reasonable purposes for which it is required by the local authority of the district;

(b.) Any difference as to whether the water or gas which any such company are able and willing to supply is proper and sufficient for the purposes for which it is required, or whether the purposes for which it is required are reasonable, or if and so far as the charges of the company are not regulated by Parliament us to the terms of supply, shall be settled by the Local Government Board, after such enquiry as they may think fit;

(0.) The county council before making any order under this sec

tion shall cause notice of the application to be published in such manner as they think necessary for giving information thereof to all persons interested, and shall hear and consider all objections and suggestions made with respect to the pro- posed order, and shall publish in manner above mentioned the order when so made; and if within one month after the publi- cation of such order any local authority or any person or body of persons directly affected by the order petition the council that the order shall be laid before Parliament, the order shall he provisional only until it is sanctioned by Parliament, and the provisions of this Act with respect to provisional schemes sanctioned by Parliament shall apply.]

(d.) Every order and scheme shall contain a provision for the cesser of the powers conferred by it in accordance with the Gas and Waterworks Facilities Act 1870;

(e.) Section six of the Electric Lighting Act 1882 shall apply to c. 70.

every order or provisional scheme for lighting by electricity. (f.) In this section and the preceding section with respect to tramways "local authority" and "road authority" shall have the same meanings as are given them by the Tramways Act 1870.
