The council may at any time release from the performance of A.D. 1888. any duties any such existing officer whose services they may deem unnecessary, but any person so released shall be entitled to compensation under this Act.

[qu. Every officer whose average remuneration is required to be ascertained, and] every person who is entitled to compensation, as above-mentioned, shall deliver to the county council a claim under 20 his hand setting forth the whole amount received and expended by him or his predecessors in office, in every year during the period of five years next before the passing of this Act, on account of the omoluments [which he claims to have included in his averago re- muneration, or] for which he claims compensation, as the case may 25 be, distinguishing the offices in respect of which the same have been received, and accompanied by a statutory declaration under the Statutory Declaration Act, 1885, that the same is a true 5 & 6 W. 4. statement according to the best of his knowledge, information, and c. 69. belief.

Such statement shall be submitted to the county council, who shall forthwith take the same into consideration and, [as the case may be, ascertain the amount of the average remuneration or] asseFS the just amount of compensation (if any), and shall forthwith inform the claimant of their decision.
If a claimant is aggrieved [by the amount of the average remuneration ascertained, or] by the refusal of the local authority to grant any compensation, or by theamount of compensation assessed, or if not less than one third of the members of the county counoil subscribe a protest against the amount of the [average remuneration 40 or] compensation as being excessive, the claimant or any subscriber to such protest (as the case may be) may, within three months after the decision of the county council, appeal to the Commis.
