La Conférence générale de l'Organisation internationale du Travail, Convoquée à Genève par le Conseil d'administration du Bureau international du Travail, et s'y étant réunie le 8 juin 1949, en sa trente-deuxième session, Après avoir décidé d'adopter diverses propositions relatives à la revision partielle de la Convention sur le logement des équipages, 1946, adoptée par la Conférence à sa vingt-huitième session, question qui est comprise dans le douzième point à l'ordre du jour de la session,

Considérant que ces propositions devraient prendre la forme d'une convention

internationale,

adopte, ce dix-huitième jour de juin mil neuf cent quarante-neuf, la convention ci-après, qui sera dénommée Convention sur le logement des équipages (revisée), 1949:

PARTIE I. DISPOSITIONS GÉNÉRALES

Article 1

1. La présente convention s'applique à tout navire de mer à、 propulsion mécanique, de propriété publique ou privée, affecté, pour des fins commerciales, au transport de marchandises ou de passagers et immatriculé dans un territoire pour lequel la présente convention est en vigueur.

2. La législation nationale définira quand un navire sera réputé navire de mer pour l'application de la présente convention.

3. La présente convention ne s'applique pas :

a) aux navires jaugeant moins de 500 tonneaux ;

b) aux navires dont la voile est le principal moyen de propulsion, mais qui sont équipés d'une machine auxiliaire ;

c) aux navires affectés à la pêche, à la chasse à la baleine ou à des opérations analogues;

d) aux remorqueurs.

4. Toutefois, la présente convention s'appliquera, dans la mesure où cela sera raisonnable et praticable:

a) aux navires de 200 à 500 tonneaux ;

b) au logement des personnes affectées au travail normal du bord sur les navires affectés à la chasse à la baleine ou à des opérations analogues.

5. En outre, il pourra être dérogé, à l'égard de tout navire, à la pleine applica- tion de l'une quelconque des prescriptions de la Partie III de la présente con- vention, si, après consultation des organisations d'armateurs et/ou des armateurs et des organisations reconnues bona fide de gens de mer, l'autorité compétente estime que les modalités de la dérogation entraîneront des avantages ayant pour effet d'établir des conditions qui, dans l'ensemble, ne seront pas moins favorables que celles qui auraient découlé de la pleine application de la convention. Des détails sur toutes les dérogations de cette nature seront communiqués par le Membre au Directeur général du Bureau international du Travail, qui en informera les Membres de l'Organisation internationale du Travail.

(c) the term & passenger ship" means a phin in gespect of which there is in

gespeel force either safety certificate issued in accordance with the provisions of the International Convention for the Safety of Life at Sea for the time being in force or (ii) a passenger certificate;

(d) the term officer" means a person other than a master ranked as an officer by national laws or regulations, or, in the absence of any relevant laws or regulations, by collective agreement or custom;

(e) the term "rating" means a member of the crew other than an officer;

(f) the term "petty officer " means a rating serving in a supervisory position or position of special responsibility who is classed as petty officer by national laws or regulations, or, in the absence of any relevant laws or regulations, by collective agreement or custom;

(g) the term crew accommodation" includes such sleeping rooms, mess rooms, sanitary accommodation, hospital accommodation and recreation accommodation as are provided for the use of the crew;

(h) the term "

prescribed" means prescribed by national laws or regulations or by the competent authority;

(i) the term "approved" means approved by the competent authority; (j) the term "re-registered" means re-registered on the occasion of a simul- taneous change in the territory of registration and ownership of the vessel.

Article 3

1. Each Member for which this Convention is in force undertakes to maintain in force laws or regulations which ensure the application of the provisions of Parts II, III and IV of this Convention.

2. The laws or regulations shall—

(a) require the competent authority to bring them to the notice of all persons concerned;

(b) define the persons responsible for compliance therewith;

(c) prescribe adequate penalties for any violation thereof;

(d) provide for the maintenance of a system of inspection adequate to ensure effective enforcement;

(e) require the competent authority to consult the organisations of ship- owners and/or the shipowners and the recognised bona fide trade unions of seafarers in regard to the framing of regulations, and to collaborate so far as practicable with such parties in the administration thereof.

PART II. PLANNING AND CONTROL OF CREW ACCOMMODATION

Article 4

1. Before the construction of a ship is begun a plan of the ship, showing on a prescribed scale the location and general arrangement of the crew accommoda- tion, shall be submitted for approval to the competent authority.

2. Before the construction of the crew accommodation is begun and before the crew accommodation in an existing ship is altered or reconstructed, detailed plans of, and information concerning, the accommodation, showing on a pres- cribed scale and in prescribed detail the allocation of each space, the disposition of furniture and fittings, the means and arrangement of ventilation, lighting and heating, and the sanitary arrangements, shall be submitted for approval to the competent authority: Provided that in the case of emergency or temporary
