such cases in accordance with the provisions under the Civil Service Regulations. With reference to Mr. To's question, I have the following reply:

(a) If a staff member is absent without leave nor permission whilst on duty, the Department will try to contact him immediately by making phone calls to his home and by other possible means.

(b) If the staff member is absent from duty for 7 consecutive days without permission, the Department will issue a letter requesting him to state the reason for his absence within 21 days. The Department will consider issuing a notice of dismissal if no satisfactory explanation is received after the 21-day period.

(c) Under special circumstances, the Department will consider rescinding the dismissal decision described above. For instance, after issuing the notification of dismissal, if the staff member is able to provide a satisfactory explanation for his absence from duty, the Department will consider allowing him to resume duty. Moreover, if there is evidence showing that the staff member was absent from duty because of death, the Department may rescind the dismissal decision.

(d) When determining whether a staff member 'died as a result of discharging his duties', the Department will, in accordance with the established procedures, first inform the Commissioner for Labour, and then consider the case and make decisions in conjunction with the Secretary for Justice in the light of the specific circumstances of each case.

(e) Regarding the case that the staff member is absent from duty without permission, the Department handles the matter according to Section 10(3) of 'Public Service (Administration) Order 1997' and paragraphs 5.34 to 5.56 of the Procedural Manual on Discipline issued by the Civil Service Bureau. As for whether the staff member died as a result of discharging his duties, the matter will be handled according to Section 792 to 794 of 'Civil Service Regulations'.

(f) To ensure the safety of its staff when they discharge their duties in desolate rural areas, the Department not only provides relevant training courses on safety at work for supervisory staff, but also makes appropriate arrangements in different situations and circumstances. For example, duty groups in the Pest Control Section are normally composed of 3 persons at least, i.e., 2 Workman I are under a Ganger.

The above is the reply of the Administration Select Committee.

MR. DANIEL TO BOON-MAN (in Cantonese): Mr. Chairman, I have a supplementary question. There have been real examples of the Department invoking in its letter Section 63 of Colonial Regulations modeled on Sections 6 and 9 of the 1988 Civil Service Regulations on Disciplinary Proceedings to dismiss staff members gone missing. Upon dismissal, the staff concerned loses his
