MR. FREDERICK K. K. FUNG (in Cantonese):—Mr. Chairman, I am opposed to this motion. I have three reasons for so saying. First, some of the increases are unreasonable, especially in relation to the Itinerant Hawker Licences. Licensees of the Itinerant Hawker Licences are not provided with any sort of service by the Urban Council. For the other licensees, they have a pitch assigned for their exclusive use. For example, the newspapers hawkers have fixed sites for doing business and the mobile vans could park in the street and carry out business there. But for the Itinerant Hawker Licences, the hawkers have to move from place to place to do business; otherwise, they could be arrested. I recall in the Green Paper on hawker policy, we accepted that hawking is a form of service to the public and we urged the Central Government to provide sites for us to resite our Itinerant Hawker Licences. The Green Paper has been approved for some years, but right now the Central Government has not offered any form of assistance to resite the itinerant hawkers. On the other hand, when we increase licence fees, the Itinerant Hawker Licence fees will be treated on par with other licences. I think this is unfair to them. I think that the increase in respect of Itinerant Hawker Licences amounts to almost 50%, because they used to pay only $600 licence fee and they will have to pay $900 in September. I think that for the motion in general, I agree with the other increases, with the exception of the increase for Itinerant Hawker Licences. I think that an increase of $150 is a reasonable one.

MR. HILTON CHEONG-LEEN (in English):—Mr. Chairman, I have sympathy with the point raised by Mr. FUNG Kin-kee. His point was discussed extensively both in the Markets and Street Traders Select Committee and also in the Standing Committee of the Whole Council and in the Finance Select Committee, of which Mr. BERNACCHI is the Chairman. The most difficult aspect is that the Department is unable at this stage, for a number of practical reasons, to differentiate between itinerant hawkers who are fixed in their trading positions and those who hawk from point to point. After very extensive discussion by the three select committees concerned, it was decided, with one or two dissensions, that this is the fairest formula all round.

The question was put.

The motion was carried with 23 votes for, 4 against, and 2 abstentions (The Chairman did not vote).

3. MISS VICTORIA CHAN YING, VICE-CHAIRMAN OF THE LIBRARIES SELECT COMMITTEE, moved the following motion:—

'RESOLVED that the Designation of Libraries (Urban Council Area) (No. 2) Order 1989 be made under section 105K of the Public Health and Municipal Services Ordinance, Cap. 132.'

She said (in English): Mr. Chairman, the purpose of the Order is to cancel the designation of the Mong Kok Public Library at Shop A on the ground floor of No. 17 Playing Field Road, Kowloon, as a library and to amend the schedule to the Designation of Libraries (Urban Council Area) Order 1986.

Sir, I beg to move.
