CHAIRMAN (in English):-Ladies and Gentlemen, the meeting is called to order. Before taking the first item on the agenda, I would like on your behalf to congratulate the absentee, Mr. PAO Ping-wing, on his being just appointed as a Justice of the Peace. (applause)

The minutes of the meeting held on 9 June 1987, were confirmed.

The following paper was laid on the table:-

(1) Report to the Urban Council by the Director of Urban Services and Secretary, Urban Council, for the month of June 1987.

MOTIONS

1. DR. RONALD D. B. LEUNG, CHAIRMAN OF THE ENVIRONMENTAL HYGIENE SELECT COMMITTEE, moved the following motion (in English):—Mr. Chairman, as Chairman of Environmental Hygiene Select Committee, I rise to move the motion standing in my name:—

'RESOLVED that the Places of Amusement (Urban Council) (Amendment) (No. 2) By-Laws 1987 be made under section 92B of the Public Health and Municipal Services Ordinance, Cap. 132.'

Under the existing Public Health and Municipal Services Ordinance (Chapter 132) and the Places of Amusement (Urban Council) By-laws, there is no provision enabling the licensing Authority to refuse the transfer of a licence issued under the By-laws, such as the public billiard saloon, the public bowling alleys, the public skating rink, and the public tennis saloon licences. The transfer of licence has to be effected unconditionally even though there is an objection raised by the Commissioner of Police on the grounds that the transferee is unsuitable to be a licensee because the licensing Authority has no power under the Ordinance or the By-laws to refuse such a transfer. This situation has been considered undesirable by the Commissioner of Police and the Secretary for Security and some form of control over the transfer of these licences is necessary.

These amendment by-laws, therefore, will restrict the transfer of licences in respect of places of amusement in the Urban Council area.

2. MR. SAMUEL P. W. WONG, CHAIRMAN OF THE RECREATION SELECT COMMITTEE, moved the following motion (in Cantonese):-Mr. Chairman, as Chairman of the Recreation Select Committee, I rise to move the motion standing in my name:---

'Resolved that the Public Swimming Pools (Urban Council) (Amendment) (No. 2) By-laws 1987 be made under Section 42 of the Public Health and Municipal Services Ordinance, Cap. 132'.

The purpose of the amendment to the By-laws is to give swimming pool supervisors the authority to refuse admission to swimming pools or the surrounding areas to any person thought to be suffering from communicable or cutaneous diseases; to provide definition of 'communicable disease' and 'supervisor' and to increase penalties for offences from $250 to $1,500 under the By-laws. This will help provide a more decent and safer environment for swimmers.
