'RESOLVED that the Commercial Bathhouses (Amendment) By-laws 1983, the Swimming Pools (Amendment) By-laws 1983, the Offensive Trades (Amendment) By-laws 1983, the Places of Amusement (Amendment) By-laws 1983, the Undertakers of Burials (Amendment) By-laws 1983, the Funeral Parlour (Amendment) By-laws 1983 and the Places of Public Entertainment (Licences) (Specification of Fees) Notice 1983 be made under sections 35, 42, 49, 92B and 123 of the Public Health and Urban Services Ordinance, Cap. 132 and section 7A(1) of the Places of Public Entertainment Ordinance, Cap. 172.'

He said (in Cantonese):—Mr. Chairman, as Chairman of the Environmental Hygiene Select Committee, I rise to move the motion standing in my name.

The amending By-laws made under the Public Health and Urban Services Ordinance and the Places of Public Entertainment (Licences) (Specification of Fees) Notice 1983 made under the Places of Public Entertainment Ordinance now before the Council will, when adopted, increase licence fees for:—

(a) commercial bathhouses;

(b) funeral parlours;

(c) offensive trades;

(d) places of amusement;

(e) swimming pools;

(f) undertakers of burials; and

(g) places of public entertainment.

The previous increase in fees took effect on 1 April 1981. Since then, the Council has been confronted with increasing administrative costs in the licensing and control of these businesses. This control is intended to maintain adequate standards of hygiene for the protection of public health. It is estimated that there will be a deficit of $883,000 in the coming fiscal year, if the existing fees are not revised.

The purpose of these amending By-laws and Notice is to help meet this deficit. If adopted, the break-even point will be achieved.

All the increases now proposed have been carefully considered by the Environmental Hygiene Select Committee and the Standing Committee of the Whole Council, and I am satisfied that due weight has been given to all the implications of the proposals.

'RESOLVED that the Food Business (Amendment) By-laws 1983, the Frozen Confections (Amendment) By-laws 1983 and the Milk (Amendment) By-laws 1983 be made under section 56 of the Public Health and Urban Services Ordinance, Cap. 132.'

She said (in Cantonese):—As Chairman of the Food Hygiene Select Committee, I rise to move the motion standing in my name.

The Food Business (Amendment) By-laws 1983, the Frozen Confections (Amendment) By-laws 1983 and the Milk (Amendment) By-laws 1983 made under the Public Health and Urban Services Ordinance now before the Council will, when adopted, increase the fees for the various licences and permits issued under these By-laws. These include licences issued in respect of restaurants, food factories, siu mei and lo mei shops, fresh provision shops, cold stores, factory canteens, frozen confection factories, and milk factories.

The existing fees have not been increased since 1981, because so far the revenue has covered the related expenditure. However, because of rising administrative costs, this will not be the case for the coming fiscal year. If the licence fees remain at their present level, there will be an estimated deficit of $3.5 million.

The purpose of these amending By-laws is to help to cover the annual cost of administering the licensing and control system for these businesses in order to maintain standards of food hygiene and to safeguard public health.
