2. MRS. E. ELLIOTT, CHAIRMAN OF THE LIBRARIES SELECT COMMITTEE, moved the following motion:
'RESOLVED that the Library (Amendment) By-laws 1979 be made under section 105L of the Public Health and Urban Services Ordinance, Cap. 132:' She said (in English):—Mr. Chairman, As Chairman of the Libraries Select Committee, I rise on the motion standing in my name.
In authorizing the Principal Crown Counsel, Urban Council, to draft the necessary amendments to section 105L of the Ordinance and Part IVA of the Library By-laws for the purpose of the video cassette library, Members of the Libraries Select Committee initiated a proposal to look into other additional amendments to cover a comprehensive range of new activities in the libraries not covered in the original by-laws.
The general effect of the amended by-laws is:
(a) to provide that even where the last day for returning a book is a public holiday, the book must be returned on that day if the library is open;
(b) to impose a limit on the charges for overdue books but allow the Librarian, instead, to suspend the borrower's ticket temporarily;
(c) to replace the existing provisions of listening libraries with new provisions for the control of areas of a library which are set aside for listening to records or viewing films;
(d) to extend the provision of certain by-laws to 'library material', i.e. not only books but also records, films and tapes;
(e) to make miscellaneous provisions dealing with behaviour in libraries, e.g. to prevent a person from taking personal books and notes for study into areas of the libraries not specified for study, to prohibit a person from sitting on a book shelf or on the floor, or from moving furniture or equipment from its designated place.
The purposes of the amended by-laws are to enable the Council to provide for control over a wider range of library material and activities and safeguard the rights of other library users. The by-laws make a number of other minor amendments, whilst at the same time retaining a large measure of flexibility.
