"RESOLVED that the Pleasure Grounds (Amendment) (No. 2) By-laws 1976 be made under section 109 of the Public Health and Urban Services Ordinance, Cap. 132."

He said: Mr. Chairman, I rise to move the motion standing in my name.

The amendment proposed to the Pleasure Grounds By-laws will make it an offence for any person to feed an animal, bird or fish kept in a pleasure ground or to throw or place anything in any cage or in any enclosure to which the public are not admitted. The offence is punishable by a fine of up to $500 and imprisonment for 14 days, which are the penalties for all other offences under the By-laws.

I now move that the Pleasure Grounds (Amendment) (No. 2) By-laws 1976 be made under Section 109 of the Public Health and Urban Services Ordinance, Cap. 132.

"RESOLVED that the Hawker (Permitted Area) (Amendment) Declaration 1976 be made under By-law 4(1) of the Hawker By-laws."

He said: Mr. Chairman, I rise to move the motion standing in my name.

The declaration referred to in the motion will permit the clearance of all hawkers trading around the Mong Kok New Market building so that civil engineering works can be carried out in the area. It is also required to make enforcement against hawking there possible so that, hopefully, the Mong Kok New Market will be viable by being free of hindrance and competition from hawkers around the market. This is in line with current Council policy.

Members will wish to know that this new market is nearing completion and will be commissioned in August or September this year. Members of the Works Planning Select Committee, including myself, inspected the Market on Saturday, 5th June, 1976.

I now move that the Hawker (Permitted Area) (Amendment) Declaration 1976 be adopted.

May I ask the proposer of the motion, since this is talking about a Hawker Permitted Area and I presume that it is referring to hawkers who are illegal or at least operating illegally as mobile hawkers or taking up a street in an illegal way, could I have some explanation as to whether or not there are any legal hawkers operating in that area. When I say "legal" I mean fixed pitches who have been allowed to operate there in a legal way. Are they going to be looked after or are they just going to be hurled out in favour of the other hawkers coming into the market?
