I can recall, but I can't be very exact, that the new proposed legislation may provide a variable size, but the Chairman of the Hawker Committee is not here. However, as that has been decided by the Committee then it would be starting a new by-law.
MR. A. de O. SALES: -Mr. Chairman, on a point of order. I am not speaking either on the Motion or the amendment. First point of order, there is a Motion which has been proposed by Mr. BERNACCHI, seconded by Mr. Henry Hu. Secondly, an amendment has been introduced by Mr. LOBO, seconded by Mr. Peter P. F. CHAN, so anyone who speaks after the amendment would be speaking on the amendment and not the amended Motion, because the amendment has not yet been passed by this Council. We have not yet taken a vote on the amendment, so there is no amended Motion. It is just an amendment of the main Motion, so we are speaking on that. An amendment, nothing more. Afterwards, if the amendment is passed, then the Motion, as amended, will be open for discussion by the Council.
CHAIRMAN: I'm sure we're all very grateful for your guidance, Mr. SALES, I think the word "amendment" and the word "amended” do tend to get muddled up on people's tongues, including my own. I hear any other Member who wishes to speak on the amendment Motion?
MR. BERNACCHI: -Mr. Chairman, I will exercise my general right of reply. The Hawker Policy Select Committee has, to my knowledge, been reviewing this particular question now for two years or more. Every factor must surely have already been considered, so either fix the time, say, within two months, for reporting to the main Committee, or fix the size today, which is my Motion.
CHAIRMAN: -I now take a vote on the amendment Motion, which is, "Now that the issue of further pedlar licences has been discontinued, this Council is agreed that the normal dimensions of all fixed pitch stalls and fixed pedlar stalls shall be reviewed by the Hawker Policy Select Committee and its decision presented to the Whole Council for its final approval and implementation."
Will those in favour of the amendment Motion signify in the usual way.
The amendment was carried with 17 votes for and 4 votes against.
MR. BERNACCHI: -I would now like to move an amendment to the amended Motion (Laughter) by adding the words "within two months".

CHAIRMAN: -The amended Motion is proposed to be further amended by the addition of the words "within two months".
MR. SALES: -May I have your permission to ask my Friend, Mr. BERNACCHI, a question through you, Sir? Has Mr. BERNACCHI, with his vast experience of the Council, overlooked the fact that (a) August is a holiday month for the Urban Council select committees, with the exception of my own, the Recreation and Amenities Select Committee (laughter), and secondly, that the Chairman of the Hawker Policy Select Committee is still away from Hong Kong, so has he been consulted as to when this matter could be put on the agenda? May I suggest to Mr. BERNACCHI if it's his intention to give Mr. Hilton CHEONG-LEEN two months, he may as well give him three months, in consideration of August being a holiday month.
MR. BERNACCHI: If my seconder agrees to amend to three months.
MRS. ELLIOTT: -Two working months.
MR. BERNACCHI: -I have the consent of the seconder, within three months, which, in other words, within two working months.
CHAIRMAN: -I am sure there's something excessively informal going on, which escapes me, (laughter) but I will now put to the Council the amendment to the amended Motion to the effect that the words "within three months" be added to the end.
MR. PETER C. K. CHAN: -Mr. Chairman, I think that the amendment to the amended Motion has not been debated, and I have no chance of speaking. In view of the absence of Mr. Hilton CHEONG-LEEN, who is the leader of the Civic Association; anyway, I must ask that Mr. BERNACCHI will agree to this rather than I move another amendment to the amendment. Within three months by all means, unless extended by the Standing Committee of the Whole Council, because I think that will be fairer. I don't think the Hawker Policy Select Committee will ask for an extension of time, they would like to do it as quickly as possible, as far as I know, but I think "unless extended by the Standing Committee of the whole Council" will give a certain safety valve in case the departmental effort has not quite measured up to the desire of the Council.
MR. SALES: -On a point of order. Mr. CHAN suggested-rather, he threatened Mr. BERNACCHI that he might move an amendment to Mr. BERNACCHI's amendment. I would like to remind Mr. CHAN that Council can only entertain one amendment at a time. (Laughter).
