MOTION.

THE CHAIRMAN, URBAN COUNCIL moved the following Motion:

"RESOLVED

That the present 'Hawkers Select Committee' be renamed the

'Hawker Policy Select Committee'.

Under Section 60(1) of the Urban Council Ordinance, that the powers and functions of the Hawker Policy Select Com- mittee shall be:

"To determine overall hawker policy'.

Under Section 59 of the Urban Council Ordinance, that a Committee named the 'Hawker Management Select Com- mittee' be established with the following membership: -

Mr. D. J. R. BLAKER Mr. B. A. BERNACCHI

Mrs. E. ELLIOTT

Mr. R. H. LOBO

Mr. James M. H. Wu

Mr. Peter P. F. CHAN

Under Standing Order 22(6), that the Chairman of the Hawker Management Select Committee shall be Mr. D. J. R. BLAKER.

Under Section 60(1) of the Urban Council Ordinance, that the powers and functions of the Hawker Management Select Committee shall be:-

(a) To implement the overall hawker policy determined by the Hawker Policy Select Committee; to exercise the powers and functions of the Council under Sec- tions 86(2) and (3) of the Public Health and Urban Services Ordinance (Cap. 132) and By-laws 4; 5; 6(1), 7(1), (5) and (6); 8(1); 9(3), (4) and (5); 10(1) and (2); 13(2); 14; 15(1), (2) and (3); 16; 21(2); 23; 24(2); 25; 26; 26A; 29(h) and 31(1) of the Hawker By-laws (Cap. 132 [sub-leg]); and to deal with breaches of licence conditions by hawkers.

(b) In the light of experience to recommend to the Hawker Policy Select Committee any changes in hawker policy or legislation which may appear from time to time to be desirable.'".

He said:-Members will recall that at the Standing Committee meeting on the 8th October 1968, it was agreed to change the name of

the Hawkers Select Committee to the "Hawker Policy Select Committee” with the powers and functions "to determine overall hawker policy”, and also to form a Hawker Management Select Committee with the terms of reference and the membership given in the resolution. The purpose of this resolution is to ratify the change of name and the powers and functions of the Hawkers Select Committee and also the establish- ment, composition and terms of reference of the new Hawker Manage- ment Select Committee. I beg to move.

MR. BERNACCHI:-I beg to second the Motion.

The question was put.

The Motion was carried unanimously.
