It was stated that the plaintif was Mr. Brenda Mary Victoria O'Reilly, the illegitimate daughter ! of one, Florence Emily Cregeen.

Florence Cregeen made a will: appointing her daughter her ad- ministratrix and leaving her all; her property. When she died in May, 1932, the Insurance money's for her life polleles were claimed hy and paid to her niece, Misa Doris Edith Rose, both Miss Rose and the company being unaware of the existence of the daughter or the will.

The sums payable under the policies were now claimed by Mrs, O'Reilly. The company, in re- sisting the claim, rolled On the proviso in the policies,
