ANOTHER LABEL CASE.

"MADE IN GERMANY" BUT- FROM JAPAN

Appearing before Mr. Balfour in the Central Police Court yesterday, Mr. O. E. C. Marton, on behalf of the China United Lamp Co., of Hamilton House, Shanghai, summoned the Tal Yeung Electric Co, of 27, Bord Street, Hongkong, for the possession of Incandescent electric lamps ing wrappers which bore the false trade description of "Mado in Ger many." and also labels, which

in colouring and general "get-up" form- ed an infringement of the Osram labels.

Mr. G. K. Hall Brutton, appearing for the defendant, pleaded guilty to the first summons, and dented the second, arguing there was no mention about coloration In the Ordinance about trade description.

Mr. Marton argued that even with the words "Mado in Germany" eliminated, the trade mark would still be an infringement.

Mr. Hall Bratton said there was a Japanese firm called the Fukui Elect trie Trading Company, carrying on business in Japan. It was from them that his client received his consign- ment of lamps with wrappers bearing "Made in Germany." Before dis- covering the false wording ho had sold two cases.
