EVIDENCE GIVEN OF A "SECRET WORD"

A claim against a Chinese bank arising from a draft was continu- ed before the Pulsne Judge, Mr. R. E. Lindsell, at the Supremo Court to-day,

Wong Wing (Vin) Lee, alias Wong Fook, claimed from the Eu Yan Sang firm, as payers of a draft (Pun character) for $700.

Mr. M.. A. da Silva represented plaintiff and Mr. M. K. Lo appear- ed for defendunt, Mr. F. H. Losoby represented a third party who were, guarantors of the draft.

Mr. Silva made an application to be permitted to bring evidence of a Chinese banking custom.

Objection was made by Mr. Lo. and Mr. Losoby, who submitted that the evidence was irrelevant and He Lordship said he would' con- sider the application Inter,

Wong Sik Yung, alias wong Kin Sau who was called by Mr. Lo, gave evidence that he worked for plaintiff In Siam and brought his children back to China for him when he returned. Witness took out n draft for $700 in Stam and agreed upon a secret word to be used to effect payment in Hong- kong. Witness, who still retained charge of the draft, lost it in May, 1932, and informed the bank who advertised for its recovery. It was not forthcoming however, and as witness know the secret word, payment was made to him a month later.
