Shortly after the appointment, sometime in April, the two defen dants in the case started a small shop in the same business at 372. It was discovered that various articles which were the subject of the present charges, had been transferred from the com plainant's shop to the premises of The defendants,

Statements made by the defen dants in answer to the charges were that they had only temporarily barrowed the goods. Against the first defendant there was also a charge of his having collected $47.41 from the Sun Kee Yoon Yut Restaurant which had not been ac counted for, while an additional charge was that of misappropria- tion of a second sum of $24.88 he had received in the course of his duties.
