The question whether should be paid on an article on which duty had already been paid, arose in a case before Mr. Butters, at the Kowloon Magistracy yester day afternoon, in which Li H, a Chinese, employed as a pantry boy on the Empress of Japan. was Officer Tallon charged by Revenge with having been in possession of 9820 cigarettes on which duty had not been paid, on November 19.

Mr. F. 11. Loseby, appearing for the defendant, admitted that his ellent had committed a breach of the ordinance in that he had int ported cigarotles into the Colony, but, at the same time he aubmittri that the defendant used to sell cigarettes to the steerage pussen- Kers and crow or the Empress of Japan, and he had bought these cigarettes in Hongkong before the vessal sailed on her trip, and the cigarettes, which formed the sub- 4783,ject of the charge, wore the re- mainder of the original lot.
