PASSES AWAY.

FORMER SPORTSMAN.

It is with deep regret that we have to record the death, which took place at the Kowloon Hospital last night, of Mr. Clade Earnshaw, who, for the past six years, has been manager of the Palace Hotel, He was only taken ill yesterday morning and went into hospital, but died shortly after seven o'clock, following a fit.

The fact that defendant had been arrested in Canton on what was termed by Mr. Eldon Potter K.C., as an utterly false charge

Being, as he was, widely known of embezzling millions of dollars, and was later released after and highly respected by a large circle of friends, the news of his spending some time in guol, was death will come as a great surprise revealed when the land dispute to many residents of the Colony in case WAS resumed at the which the late Mr. Earnshaw had Supreme Court before the Chief spent the past ten years, during Justice (Sir Joseph Kemp) this which time he had become a popu-

It was in 1920 that the late Mr. Earnshaw arrived in the Colony as member of the Hongkong Police Force; being accompanied by his brother, the late Mr. Reginald Earnshaw, who it will be recalled. lost his life in a parachute jump at Kai Tak on Chinese New Year's Day in 1925, during the inaugural ceremony of the Abbott Flying School.

Mr. Potter elicited the above in formation from Lau Yick-cheuk

(plaintiff) in the course of cross-a examination, and explained that although it was not absolutely re- levant it was useful as showing the attitude of the parties.

Plaintiff was cross-examined by Mr Potter. He said he knew that defendant was the executrix of Lau Yu-fonga will but he did not know whether or not she was the sole beneficiary.

After serving in the Police Force for some years, both brothers in- terested themselves in aviation, al- Mr. Potter:-Do you mean to though Claude was not as active say you have never heard that be- as his brother, who joined Mr. fore. death of Mr. R. Earnshaw, which put an end to the activities of the School.

Forgot then Remembered. You mean to say you have no knowledge of the contents of your brother's will-I know that there is a will but I don't know the con- tents of it.

You have never had it read to you by anyone? Yes, someone

read the will to me.

Well, did the will say that this lady was the sole beneficiary ?-- Well, it is so long ago that I don't remember it.

I put it to you that is an absolute untruth and you know very well this Indy is the sole beneficiary under

a very short will as everybody knows?--Yes, it was read out to me that she was the sole beneficiary.

Well, why didn't you say 50 when I asked you?-He has some adopted sons,

Arrest in Canton.

You are aware, are you not, that she was arrested last August in Canton was then away in Shanghai.

On your oath, have you ever heard that she was arrested?—I heard of, it after she had been arrested.

After remarking that it was not fabsolutely relative, but served to show the attitude of the parties to each other and the suggestion that| defendant was the villain," Mr. | Potter asked:--And she WAB arrested on the information of your brother, K.C. Lau (Lau Kwai-! cheuk)?

Mr. Claude Earnshaw then join- ed the Palace Hotel, of which he had been manager on and off for the past six years. He quickly made a large circle of friends and was an enthusiastic member of the R.A.O.B., with which Order he was connected for several years and held the position. of Secretary Of a courteous disposition, the Earnshow was always late Mr. ready to serve others, and his death at the early age of 31 will be re- gretted by everyone who knew him. He was a native of Swanley, Kent, and was two years older than his late brother.

During the earlier days of his residence in the Colony, the late Mr. Earnshaw was a keen cyclist and was always a billiards player of nerit. He was a regular com petitor in the tournaments which, until quite recent years, were or ganised by the Palace Hotel.

We understand that he is sur- vived by his mother and father and a sister at Home, and to them much sympathy wil be extended in their sad loss.

The funeral will take place at Happy Valley this afternoon, the cortege passing the Monument at

PLANE DROPS INTO GAS TANK!

PILOT AND PASSENGERS KILLED.

Chicago, Aug. 12,

A tourist plane, flying over the city at a low altitude, crashed on to one of the huge gas tanks in the suburba. The violence of the contact caused the cover to give way, and the plane dropped into the interior of the tank.

Mr. Sheldon objected to the question saying that K.C. Lau had nothing to do with the case and it was irrelevant. What other people did, he said, was absolute- ly unconnected" with the case. A diver to-day, succeeded

Cause of Arrest.

Mr. Potter:-You mean to say that although you have heard she was arrested you have never been told by anyone in the whole world why she was arrested and you don't know to this moment?-K.C. Lau told me when I came back.

And he did not tell you it was on his information ?-He did not tell me that.

Do you tell my Lord you have no idea who initiated these pro- ceedings against defendant in Canton concerning Lau Ping's estate?-Lau Kwai-cheuk.

Why didn't you say that when I asked you? You said you didn't know.

Answering further questions by Mr. Potter, on another aspect of the case, plaintiff agreed there was no entry in the books which showed money under the name of Lau Ping, deceased, but explained that Lau Kwong Yu Tong meant Lau Ping. Money standing in the name of Lau Kwong Yu Tong meant Lau Ping.

CONTROL OF PEKING & TIENTSIN.

BAIT FOR ASSISTANCE IN CIVIL WAR.

CHANG'S CIVIL WAR:

Peking, Aug. 20.

In a final effort to form a Shansi - Manchurian alliarice, Marshal Yen Hsi-shan on Mon- day telegrapfied to General Chang Hsueh-liang, head of the Manchurian Government, agree- ing to a complete withdrawal of all Shansi garrison forces from Peking and Tientsin, giving up the control of the territory to the Manchurian Government on the condition that the Man- churian leaders will organise an expedition into China Proper.

This sacrifice is made by Shansk in view of the most critical situa- tion facing the Shansi defenders loss of

after the

Emissary Disappointed. For two days there has been no reply from the Manchurian world, and this is interpreted as meaning that General Chang Hauch-liang still prefers to adopt a neutral af- titude and take no active part in the present turmoil.

Mr. Que Tai-chi, Mr. Wang Ching-wei's representative, has arrived at Peitaiho and has hand- ed a letter by the Kuomintang Leftist leader to General Chang Hsueh-liang. To avoid more poli- tical delegations, General "Chang' Hsueh-liang is returning to Muk-. den in a few days.

Railway Communication.

All passenger trains along the Tsinanfu-Kiaochow Railway re- sumed running this morning,: following the repair of the damag- cd railway bridge at Tzeho. The freight trains are expected to run to-morrow. The damaged tele- graph wires have also been repair- yesterday morning ed. Since telegraphic communication along! the Tientsin-Pukow Railway has been restored.

General Okan Tiao-yuan, the Military Governor of Shantung Province, has returned to Tsinanfu to administer the affairs of the Shantung Provincial Government.. Some 500 officials of the Govern-" ment have also returned with the Governor from Tsingtao.

Nationalist Advance,

Because of the fall of Tsinanfu the Shansi remnants along the Tsinanfu-Kiaochow Railway have been isolated and attempts by the Shansi Commander, General Shih Yu-shan, to effect a retreat of the Shansi forces from the railway have met with severe set-backs. Commanders The Nationalist have recaptured Tsingchow, the Shansi Headquarters along the Tsinanfu-Kiaochow Railway. In- termittant skirmishes between the Nanking forces and the Shansi rempants are in progress, near Tsingchow, where the Shansi troops are making a desperate at- tempt to penetrate through the Nanking lines to retreat back to Chihli Province.

General Liu Chen-nien, Officer commanding the Tsingtao troops, is assisting General Han Fu-cha in suppressing the rebels.

Yucheng Captured.

The Kwangtung and Nationalist troops in pursuing the Shansi re- ed some thirty miles from Tainan- bels have captured Yucheng, situat-

fu and only fifty miles or so from Tehchow, the first of the Shansi defence lines along the Railway.

Yucheng was captured without organised much fighting on account of the dis- state of the Shansi forces. Nevertheless the capture marks an important step in the Nationalist advance, bringing the latter forces only fifty miles from Chihli Province.

F

A big Nationalist conference now in progress at Tsinanfu is being attended by Generals Liu Chi (First Nationalist Division), Chan Shing, Hsia To-yin (13th Nationalist Division), Han Fu-chu, Chlang Kwang-wai (61st Kwang- tung Division), and Teei Ting-kai (60th Kwangtung Division). The meeting has decided to assign the control of the Tsinanfu-Kinochow Rallway to the troops of General Han Fa-chu and the garrison at Tsinanfu to General Chiang Kwang nai.
