A WITNESS.

MAJOR POINT RAISED IN EXTRADITION CASE.

Further evidence of conditions in a Cantonese prison was given in the resumed extradition case before Mr. Lindsell nt the Central Maxistracy yesterday concerning three Chinese who are wanted by the Canton police on a charge of murder in the village of Taify, in the Namhai district.

A party of men who went up there to procure photographic ex- hibits for the defence were inter- fered with, it is stated, by Chinese soldiery, and enst into. prison at

Fatshan.

What happened was detailed by Yeung Yau who testified that be fore being released, he was, with the other members of the party kept in a Chinese temple in Fat- shan. He was chained by the neck and feet, and at one, period, saw Tam Kwai, another member of the party, who looked as if he had been tortured. There were burns around his ankles, while his back also show- ed wents and bruises, suggesting that he had been severely beaten.

Tam Kwai is still in custody, al- though the other members of his party have been relènsed. Claimed by the defence as one of their most important witnesses, his detention by the Chinese authorities has been in the course of the case the subject of much criticism by Mr. Hin-shing Lo, Counsel for the de- fence, who contended that his case has been crippled thereby.

Unwarranted Interference. Mr. Lo, argaing further on the point yesterday, held that such in- terference 'was unwarranted, and he asked for the discharge of al the fugitives on the ground that there had been a deliberate inter- ference with witnesses for the de- fence by préventing them from ob- taining material evidence.

He cited authorities in support of his submission that such foreign witnesses, while engaged in the business of the Court: were entitled to the same immunity as would be extended to those figiring in a local

case.

Irrespective of whether a prime facie case had been made out or not, Counsel now asked the Court to discharge the prisoners on the ground of an attempt having been

made to pervert the course justice.
