As the outcome of the Guggon" holm contest for the safest aero- plane and the awarding of the 100,000 dollar (£20,000) prize to the Curtiss Tanager a long- threatened international disputo over aviation patents may be précipitated.

When Major James F. Cordas and his two mechanicians were yesterday busy dismantling the Handley Page 'plane (which was second in the competition), they were served with an injunction restraining them from removing the 'plane from the United States.

This action by the Curtiss Com- pany was taken after a rumour had been circulated that the Hand- ley Page Company intended to take action to prevent the award- ing of the prize to the Curtisa entrant to-morow. Its object, it was explained, was to "preserve evidence" that the Handley Page 'plane was brought here in con- tempt of a court order obtained In 1021 against Mr. Handley Page and his associates, which "henceforth forever enjoins them not to bring an aeroplane of their company into the territories of the United States."

The hearing has been set for Tierony in the Federal Court

The 1921 Decree.

The decree granted in 1021 revolves around five alleged in- fringements of Curtiss patents by Handley Page, and was taken at that time to prevent the whole- sale importation of foreign surplus: war aeroplanes into America. When an attempt to gain prolec- tion from Congress failed, the various American companies un- dertook to restrain importation by prosecuting all available patent nctions, and the Handley Page organisation was selected as the opponent of the Curtiss Company.

While not conceding the Hand- ley Page Company's clear title to the slolled wing device, it will be the contention of the Curtiss Com- pany's counsel that no infringe- ment occurred, since the 'plane employing it was purely experi mental and no other 'planes would be placed in commercial produc- tlon before the patent matters In- volved were setiled.

It is regarded as an Interesting point that one of the trustees of the Guggenheim' contest, Captain Emory, land referee of the safety competition, was a member of the United States Joint Commission which, after investigating the Handley Page claim to the slotted wing device, gave the company 250,000 dollars (£50,000) and other consideration for the right to employ the slot on "planes" of the United States Navy.
