Evidence was adduced by the prosecution to the effect that the defendant recovered the nole (for $4,000) upon payment of ten per cent of the amount owing.

Court when the defendant claimed that the paymont was made upon the understanding that it was to be in full settlement of the debt. This was denied by the owner of the note, who said that the $400 which he received was only in partial settlement.

After a lengthy hearing spread- ing over many weeks, during which a copy of the promissory note was produced in evidence, Major Willson yesterday Bold there had been a conflict of evid ence, but that he believed that the defendant's story was the more consistent of the two, and lis- charged him.
