Appearing for the prosecution, Mr. M. M ̧Watson said that the complaint was in respect of the false trade marks and descriptions, falsely resembled the United States export labels from Manila, as to bo calculated to deceive buyers into believing that the goods were the products of the El Oriente Fabrica de Tabaccos of Manila. However, an undertaking had been given by the defendants to surren der ond destroy all such marks and Inbels, to pay the costs of the pro- secution, and to publish an apo logy, for one month, in the verna-. cular papers. Under these candi. tions, it was proposed with his Worship's approval, to withdraw the summons.
When the defendants' premises at No. 122, Wellington Street were searched, it was found that there were more than 3,000 cigars to which these faise trade marks and descriptions had been applied. Mr. Watson stated that even the United States export labels from Manila had been copied.

Mr. Watson replied that they were not taking action on this point beyond the general prosecu-, tion for the mis-use of the com- plainants trade mark rights, but he hoped that the publication of the Court proceedings would have the effect of deterring two or three other similar offendera..
On the defendants' agreeing to enter into all the undertakings re-. quired by the complainants, his Worship consented to withdraw the summons.
