Glving evidence in his own de- fence, Lleut, Stonme Stanley said) that on December 4 at about 7.30 p.m. he was proceeding along" Salisbury Road from the direction! of Signal Hill to the Ferry. The speed of his, car was,about 25 miles per hour. On hearing the Junction of Nathan and Sallabury! Roads, (about 60 yards away), witncas noticed three rickshas, running at a quick pace, turn into Salisbury Road,

Witness at once horn, and seeing that the first rickshu was not in full control of the coole he immediately applied: his brakes. He slackened speed? to eight miles an hour within tent or twelve yards and could have! completely stopped if it had been necessary,
The leading. ricksha then turned to the right and as it did not; attempt to go back to the loft again, witness passed it.
The fight of Way. Continuing, witness said that he believed that traffic in Salisbury Road,, had the right of way, over traffic which appeared to be about 30 to 50 yards away, the ricksha pullers had no right to attempt to cross the road.
The Indian constable who' was on duty on the corner was ques- tioned by the defendant. He said that about 7,30 p.m. on December 4 there was a lot of traffic In Salisbury road, travelling in both directions He noticed a motor car passing at about that time, but! he was unable to state the number of the vehicle: He saw no car speeding nor did he see any car disobey the traffic signals. No rickshas had disobeyed his signals that night.
Lieut. Col. Lowis then rose and asked if he was entitled to cross- examine the witness. His Wor- ship allowed Col. Lewis to ques- tion the constable, who in cross- examination said that he was standing about ten pacca from the lamp standard.·
Addressing his Worship the Colonel said that the constable. was conspicuous by his absenco, as was generally the case
His Worship said that although Col. Lewis could ask the witness questions he 'could not makë, a statement.
Conflict of Opinion
Lieut. Sloane Stanley was then asked to return to the witness box and was asked what he meant when he said that the leading ricksha was not under full cön- trol of the puller. Witness re- plied that the coolle was running at a fast rate and was pulling backi on his shafts in order to blow dawn.
Col Lewis put it to witness that that was not correct, but Licut, Slome Stanley disagreed.

Col. Lewis asked the Court, if he ricksha coolie could be traced and was told that attempts had been, made to locate the puller, but without success.
In giving his decision; his Wor-i ship said that there seemed to be a great conflict in the evidence which had been given, The com- plainant had stated that the car was 60 yards away and the wit- ness, Mr. Standage, said 'It was about 20. That made a consider- able diferenco as to the distance' in which the car had pulled up. The defendant had stated that the leading ricksha was-out-of-control- of the puller, but this was con- tradicted by the complainant. In view of the conflict ho could not convict the defendant, Lieut Sloame Stanley would, however, be fined $10 for contempt of Court by his failure to appear on Decem- ber 20.
