An interesting decision. given by the Mixed Court, Shang- hai, on the 10th inst., in the case in which Behn, Meyer and Co. aued the Chinese Government Tele- graph Material Supply Department of the Ministry of Communications and Loh "Shang-kung and Sung Wen-hsien, to recover £563. 7s2d. and Tis. 176,25 for goods sold and delivered,

In their petition, the plaintiffs stated that on February 17, 1925, the defendants gave the plaintiffs four.cheques, amounting to £447, 48. Ed. and Tis: 162.94, payable on February 15, but that on presenta- tion they were dishonoured. Dr. H. C. Mel represented the plaintiffs and Mr. Sidney A. Mogs acted as counsel for defendants.

In answer to the petition, Mr. Moss filed a motion, stating that the first defendant was a depart- ment of the Government of the Republic of China; consequently, it was not within the jurisdiction of the Mixed, "Court and, there fore, not a proper party defendant In any action instituted in that Court. The motion further al leged that no cause of action was shown in the petition against Loh Shang-kung and Sung Wen-haien for the reason that they were em- ployees of the Republic of China, and were acting as such, and not in any individual capacity duringTM time mentioned in the plaintiffs petition.

Lord Derby, the Lord Mayor of Manchester, the Bishop of Man- chester, Mr. J. R. Clynes, Sir Henry A. Miers (Vice-Chancellor: of Manchester University), and Sir Percy Woodhouse (president of Manchester Chamber of Com merce) sign an appeal for contri- bations towards the purchase of a bronze bust of Mr. Scott which Mr. Epstein has nearly completed.

The cost is £400, and it is de sired to present the bust to the Manchester City Art Gallery. The appeal says-

"We desire in the first place to honour a most distinguished Man- chester citizen. But we are glad to think that we shall be doing. so in the way which will probably please him most-by adding a great work of art to the cityla collection."

Contributions are limited to a maximum of one guinea
