Counsel's Address.

This concluded the evidence of both parties and Mr. Fitzroy, prior to addressing to Bench read an extract from the trial of Steinie Morrison and said that the judge | in his summing up to the jury said, "Before you can day he is guilty you must be convinced that the evidence can only be explained upon the assumption that he is guilty.

Continuing Mr. Fitzroy said that the defendant was charged with being in possession of what ap- peared to be cannon in their pre- sent condition. There was no doubt that they could be used as cannon but the contention of the defence was that the seizure was premaure and the articles wer: taken away by the Police before they were completed.

The defendant acted in every way as an innocent man. He had been in gaol for the last month. and Counsel would ask his. Wor- ship to find that everything was done in accordance with the plenr. The articles were to be used in a state that would make it impos sible for them to be used as can- non.

His Worship said that the evi dence showed quite clearly that on the day of the seizure the contri- vances were cannon and parts of cannon and he had no difficulty in Anding the defendant guilty. He was charged with possession of the articles and on the question of guilty knowledge, the defendant, asked the Bench to believe that he did not know what a cannon looked like. His Worship was un- able to believe the statement anä. the defendant was therefore con- victed on the charge.
