Commendation of Would-be

Rescuer.

Mr. Robert Smith, of the Hong kong Electric Company, visa highly commended by the jury which investigated the death of the Chinese diver who lost his life on September 12, during diving operations at the Company's work atNorth Point, The enquiry was conducted by Mr. S. B. B. McElderry at the Central Magis tracy yesterday and the following served on the jury: Messrs. B, H. Lacon, (forman), A. Mackenzie," and A. H. da Silva,

The proceedings were comment- ed on Monday last and subsequent to the medical evidence" the court visited the scene of the tragedy where the various witnesses were interrogated by the Coroner and jury,

On the resumption yesterday the Coroner said the site and the div ing apparatus had been inspected, and in order to that a charge of manslaughter could be brought against any person concerned it would be necessary for the Jury to satisfy themselves that someone was guilty of gross 'carelessness. There was evidence show that

he was careless, but not sufficient. to show that he was responsible for the death of the deceased. He ld not believe there was any evidence of manslaughter and he thought the jury would with him."

With regard to the diving suit, Mr. McElderry said that if there was any carelessness on the part of the man holding the life line there was no fault with the diving suit and it would be impossible, on the evidence, to say that the owner of the suit, the sub-contrac tor who employed the deceased was responsible. The Coroner thought the jury should return a verdict of death by misadventure.

Regulations Necessary. There was however, an impers tant point regarding which the jury might add a rider, and this was whether there should be some regulations making it neces- sary for divers to be licensed, in order that there might be a regu. lar inspection of diving suits, thus preventing the decurrence of such. accidents as had happened in this

case.

He thought it advisable to call evidence with regard to the diving suit used in the fatality.

The contractor who had em.. ployed the deceased; stated that he had been in business for the last 18 years and had engaged the do- censed for diving operations for some eight years. The, coolle hold. ing the life line was employed by the diver himself and not by wit ness, who merely supplied the diving suit. The suit on this occusion had been purchased about, six months ago and witness had received complaint regarding its depreciation. It did not leak and had never been repaired.

Diving suits were always tested prior to the descent.by pumping air into them but they were never put into the water,

Asked if the life line which was used on the day of the accident was strong enough for the purpose, witness replied that, it was and it was owing to the deceased being drawn into the air pipe that the rope broke...

The jury returned a verdict of death by misadventure and added a rider to the effect that they, con sidered the action taken by Mr. R. Smith, to extricate the deceased from the intake of the air 'pump, deserved great commendation.

Although not given in evidence at the enquiry the attempt to rescue the unfortunate man, "which was made by Mr. Smith, is worthy. of note.

On finding that an accl dent had occurred Mr. Smith dived

down to the bottom of the suction pump where he saw the diver stuck head first in, the pipe with his heels about two'feet from the. outer end. On diving for a second time Mr. Smith fastened the rope to the man's ankle but the life line broke and we the man' could, 24th Nov was not dislodged by the coolles, .. 8th Doo.
