Reconstruction and the.
· Rents Ordinance.
Sir,-In a recent letter which I seat to the Press, I promised to deal fio a further letter with amendments which are required in the 'recom struction" provisions of the Renta Ordinance, and I now do so.
The reconstructión" provisions are comprised in Section 4 (1) (B of} the Bents Ordinance, 1922, which authorizes the turning out ul a tenant only if
"the lessor bona file requires possession of the domestic tone- ment in order to pull down such domestic "tenement, or ïn order to reconstruct such domestic tenement to such an extent na to make such domestic tecement building within the meaning of the Public Health and Building Ordinance, Ordin- auce No. of 1905, and shall have given she tenant

strtet such domestic tenemënt, and in the latter case stating the exact nature of the recon struction intended:" Provided that if the lessor fails to begin the work of pulling down or reconstruction within one month after the lessee shall have given up to the lessor possession of the domestic tenement, or shall fail to carry out the said work with reasonable expedition, the leasor shall, unless the contrary be proved, be deemed for the purpose of Section 90 to have. in giving auch notice, doue act mala file with intent to induce the lesser to give up possession."
The above clause requires to be amended in the following parti- culars:

pull down in livet, and the words "pulling down or in lines 14 and 15:
The above words should be de leted because
(1) They are unnecessary, as there cnnnot be any genuine pulling down except with a view to a reconstruction: and in particular,
(2) Because they lend themselves to evasion. Le.. the giving of a simple notice by the landlord)} that he "intends to pull down" such domestic tenement, without) saying anything more.
(i) The next amendment required in the clause is the insertion after the words "reconstruction intended" of the following words, namely: "and shall, prior to the giving if any such notice have obtained from the Building Authority his certificate, (a copy of which shall be attached to such notice) to the effect that such intended recon atruction would have the effect of making such domestie tenement a new building within the Public Health and Building Ordinance, 1903 and also a certificate in writing from the Assessor is copy of which certificate shall be at- tached to such notice) to the effect that such reconstruction is) in the opinion of the Assessor desirable."
The reasons for the first part of this last suggested amendment is to prevent a tenant, who ja less able to afford legal advice as to when a building is a new building within Ordinance 1 of 1903 than the landlord, from being bluffed out of the premises by the, landlord.
The reason for the last part of the suggested amendment is that it seems desirable that the Assessor, who has the best means from the returns made to bin of judging whether a considerable taming out of tenants is desirable or not and of whether other premises are available for such tenants to move into.
Another obvious argument against reconstruction (unless it is absolute ly imperative) is that it employs skilled workmen who might other- wise be better employed in erecting new buildings on fresh sites.

As I pointed out, in my previous letter to the preas other attempts by the. landlord to evade section 4 of the Ordinance ought also to be made a criminal offence, and, I would add now that it 'seems oaly fair that a landlord should be penalized for any irregular. attempt to bluff a tenant out of possession.
(iv) Another amendment required,
in the reconstruction provisions in a clause to compel the land lord to take back his former tenants in the reconstructed premises, at a rent to be settled by agreement between the parties, or failing such agreement by the Assessor whose award shall be final and conclusive.-Yours, etc.,
