Their Lordships, Sir William Rees Davies (Chief Justice), and Mr. Justice Gomperts (Paiens Judge), sitting in Appellate Jurisdiction, at the Supreme Court, this morning, beard an application in which a number of Chinese were concerned, Ho Au-obi and Young Shi-chi, the executors of the will of Ho Tee-yee, decensed, wero the plaintiffs, and Ho Tse-tsun, Ho Hong-abung, Go Chang-shi (Administratrix of the estate of Ho Tat-loo) and Chen Ho-shi were the defendants.
The Hon. Mr. H. E. Pollock, K. C., appeared for the plaintiffs, Mr. Sharp, K. O, for the first de- fendant and Mr. Eldon Potter, for the fourth; while the second and third were not represented by ojunsel, as it was only a formal application.
The appaal was from a judg ment in Chambers of the Chief Justice, as to whether the next-of- kin in the matter should be 23- certained according to Chinese law or English law, the Judge directing that the next-of-kin should be ascertained according. to the statutes of distribution in English law.
Mr. Sharp said the appeal was brought when notice was served specifically under the rule. That was to say, that they had to look at the date of the service of notice which was' March 2, Order 58, Rale 15.

Mr. Sharp said the only remain- ing point arose under the new Court of Appeal, Ordinance, the Full Court Ordinance of 1012, section 5, subsections 1 and 2, which dealt with appeals which were to be brought or heard respectively by the Full Court of two Judges or the Fall Court of He submitted three Judges,
