Before Mr. Justice Gomporiz, Puisse Judge, In the Summary Court this afternoon, G. Ru" dew, an interprefer in the service of Messrs. Thos Cook and Son, filed a suit against Lafferty, a mechanic in the Taikos Docks, to recover the sum of $331, being amount due for board and lodging and other advances. Mr. Len, d'Almada, of Messrs. Goldring. Barlow and Worrell, appeared for the plaintiff and Mr. M. Reader Harris, of Messis. Wilkinson and Grist, was for the defendant.

Mr. Almada stated that his Lordship would, notice that the claim appeared on the writ of summons as 5450. The claim included $50 a month for board and lodging from June 1st 1909, 10 February 181, ti to, a $7 fine paid by the plaintiff at the mq;est of the défendant' and $15 for money lent. The sum of $150. "was paid into Court, which brought the claim to 5332. The facts of the case briefly put were that the plaintiff about two, years ago lived with defendant's sister and in September last year married her, which was a month previons to her death, which occurred after a serious tiras. Defendant was out of employment for some considerable time and in June last was taken by the plaintiff as a ledger at $50 a month. The arrangement w. 5 that the money should be paid by the plaintiff till the defendant was able to obtain employment and that the plaintiff 'should have the amount refunded to him as seoo as the defendant obtained work. He subiequently obtained employment and paid $150 on account.

Fvidence having been called, judgment was entred for the plaintiff for $59.
