Mr. Gedge, for the prosecution, asked His Worship to impose as severe a penalty as possible to serve as a warning to Chinese who may to future try to obtain a passage to Avi- tralia.
Mr. Beavis, who appeared for one of the prisoners, stated that he wished to associate himself with the remarks of Davidson. The Ordinance which provided for the imposition of heavy penalties for ships on which stowaways were found stood by itself and had nothing to do with the nature of the pasalty to be imposed on, prisoners. The momal cetaiaty was on the side of the prisoners. The men were found in the afternoon and only the bare facis, of the case were laid before the Court. There was no evidence of güllt. His Worship sentenced two of the prisoneis to seven months' imprisonment and inflicted a fine of $10 on the fourth prisoner.
