At the meeting of the Sanitary Board this alternoon, the Medical Officer of Health sub- mitted the following minute relative to the bye law for the prevention of mesquito-brooding:

The steps to be taken to prevent the breading of these pests are the same in all cases, namely, the prevention of the accumulation of standing water, which is necessary for the development of the larvae and the removal of such brushwood, etc., as may afford a shelter to the adult insects. The bye-law merely gives power to direct that steps shall be taken for the prevention of the breeding of mosquitoes on any premises, under the advice of the Medical Officer of Health or any Assistant Medical Officer of Health, and will apply only when morqpito farem are actully found upon sach premises,

The accused files a motion to dismist based apon several grounds, some of which were con sidered in connection with a previous demand for: a second preliminary examination. It is now claimed that the warrant in this case was not issued in compliance with the Philippine Bill. This question was discussed in U. S. v. Wilson, 4 Phil. 317, where Willard, J, says:
"It is probable that the article was intended to apply to cases where an arrest without a warrant was not allowed and in which it was necessary that a warrant should be issued in order to get the accused person before the Court,"
