DECISION OF THE PATENT BUREAU, Tos decision is published in the Oficial Gesells in the case of an appeal to the Paleot Bureau by Mr. Kishi Seilch, a barrister, of Tokyo, on beha'f of Messre, A., and F. PERI, Limited, against the rotusel of application No. 47.441 by the appellaats for the registration of their trademark, The appeal was upheld. *
In giving their decision, the authorities state
that the trade-mark in this caro is a design which represents a baby in a metal basin try- ing to reach a piece of soap outside the basin by lying on its stomach, and the examiner refuted the application on the ground that the trade-mark in this case resembled those registered under numbers 17,072 and 9,101, which represented a baby in a bath of oblong shape, around which úve children were play ing with different bath, utensils, while there was a flower decoration and an inscrip

The examiners held that there was resemblance in that in both cases there was a baby bathing, But the design in this case represents a baby is a metal basin tying to reach a piece of soap, and it could not be regarded strictly as a baby in a bath, though abere was no effection to its description on "Baby in the Bath," as in the other cases.
