At half-past ten o'clock the Copri opened and immediately after that Mr. Siade proceeded to read the statement of claim-a voluminous document-which we append, in brief, below:- to the statement of claim plaintiff's stated they were silk merchants of Canton, and prior to March, 1977, or dates unknown to the plaintiff, the defendante dealt with a firm in the Colony, who were trading under the name of Cheung Loong firm, the two partnera" being Woo Yiu Nam, and Leung Tria Pang. This firm was adjudged bankrupt in 1997, and about the end of 1906, or beginning of 197, the defendants sent letter to the German Consut at Canton, what purpoiled to be the accounts of monies owing to the defendants by the Cheung Longg firm, and alto represented through the German Consul to the Chinese authorities that Laung Lai Hang, Wong Hoi Tang and Cheung Toz Yuen were partners in the Cheung Loong firm at Hongkong, aud that the firm owed the defenda's. 51,097.04 for goods contracted to be sold, and $2,171.76 for godown rent, etc. The German Consul at the request and acting for and on behalf of the defendants illegally procured the Chinese authorities to issue a warrant for the arrest of the plaintiffs, and the property and premises of the Kwong Hing Cheung firm were seized by the Chinese authori ties. To obtain the release of the

premises and to save arrest they were com pelled to give the Consul General as security $46,000. Plaintiffs claimed 'an injunction re straining the defendants from representing to the German Consul or the Chinese authorities that they were patteers in the Cheong Loong Grm of Hongkong, and $75, 00 damages to be reduced to by $46,00 on the release of the

· security given to the Consul General.

In presenting the alleged facts of the case to the jury, Mr. Slade stated that the plaintiff firm the Kwong Hing Cheung-did à large ex- port business in raw silk and other such goods in Canton, since 1893. They were successors to the Koen Cheung, which firm carried oD business in Canton some ten or twelve years previously. The plaintiff firm deal with nearly every foreign firm in Shameen, and had twelve par ners at the time of the commencement of this action, Since then, one of them had died, leaving only eleven partners at the present moment. The defendant firm did a business In the Colony and had also a branch in Cao top. Here Mr. 9lade called the jury's tention to me alteration in the pleadings for the de- fence lo which they originally stated that the Reuter Brockeimson in Hongkong and the Reuter Brocketmana in Canton were hat the same, and that they did not know what each other was doing. This statement, Coupol stated, was given up now, and that the defence had admitted that fact:
