CHINESH SEAMEN.

WHEN LAWFULLY ENGAGED?

ME Justice Sancombe Smith gave judgment yesterday morning in an appont douling with Chinese seamen engaged in the Colony, say the Singapore Frei. Press of gist ult.

The appellants were convicted on March rith, by, the Master Attendant, for an offence under section 215 (1) (b) of the Merchant Ship ping Act fur wilful disobedience to a lawful

command of the Master of the ss. Benvrickić to go to work. The point of law,taken wat that the appellants were not lawfully engagad as required by sec 275; that therefore there was

no lawful agreement to serve as seamon; that the Master could not issue a lawful com• mand to work and that therefore, there was no disobedience to a lawful, command. It was argued that the "agreement upon which the appellants had been engaged was void because it did not contain a clause which ought to have appeared in it by vinue of the last proviso to sec. 3 of Indian Act XV of 1843. The omission alleged was that the appellants being native sgamer, which the learned judge thought meant Asiatic seamen, and agreeing that their voyage shall end at n'port mat in the Colony, the agreement does not contain alipolation for providing appellanit 60 employment on board some other vessel bound for the port out of which they were shipped, viz., the port of Singapore. But that stipulation was only one of several altemstive stipulations, of which another is for providing ggamen fit employment on board some other vested bound to such other port than the part röl shipment as may be agreed oo. The learned Judge held that there were other stipulations in the agreement, covering the alternative stipul- ation referred to: "Bound direct for the United Kingdom or Continent” meant "bound direct for some përt-in the United Kingdom or **Continent; and this satisfied the requirement

of providing fit employment.

The appealfailed and the conviction must be confirmed.
