His Honour said the question before the Count was whether Mr. Curtis should be punished for his contemptuous conduct in violating the rule of the Court relating to the admission of attorneys to practise in this Court, Ih full koowledge of that zule Mr. Curtis had. appeared in Court and attempted to appear for his clients. Mr. Curtis had involved his client in difficulties and be too now appeared before the Court on citation to show causn why he should not be punished for contempt of Court.

MY, Curtis replied that there was absolutely no intention to offend this Court or violate regulations. There was no man who tried to be more courteous than himself. He thoughi he knew the law 10 thoroughly to con duct himself, in an improper way in the Court, or to use any language which ha could pot use in the presence of ladies for whom he had the greatest respect. He' bad been brought up la no atmosphere of legal ethics in the Supreme Court of the United States and this was the first time he had been cited. As a matter of legal ethics he thought the dignity of this Court ought to be maintain. ed by those who aspired to be members of the Bar. What he did for Mr. Emery was done in friendship.and in goodwill. He argued that: Counsei-who-ware-admitted-to-practise-in-the- Supreme Court America should be allowed to appear in this Court,

His Honour-This rule has been made by this Court and unless this rulo'ts rescinded by this Court or over-ruled by a higher authority it will stand and will have to be obeyed. The Count will not hear you on the question of the wisdom of or authority for making this rule of Court. The rule is here in force and if you violate the rule the regulations provide for a method by which the Court can purish you." You are now on trial for violation of the rule of the Court and you may give any explanation on that point, but on no other.

Mr. Curtis replied at length saying that he bad lost thousands of dollars through this rule; but he had borne it with patience and long- suffering, 11 was-far from his intention to offend this Court. There was not any appeal to San Francisco and he had been very careful not to transgress the rules of the Court. His common-sense and self-respect would pra- vent him from doing anything that would be contempt of this Court. He thought, If thn. Court had been in the same position so that in which he was placed, the same thing would. have been done for Mr. Emery, bald

His Honour said that Mr. Curtis. might file any, reasons be bad to offer for his conduct, between that day and Saturday: morning. He must stala spy good reason he had to show why he should not be punished. The purpose of the Court was to cite Mr. Curtis regularly and give him full opportunity to answer, but he was in Court, waived citation and offered to make a voluntary explanation. The Court would take this matter under-advisement: and, deliver its decision on Saturday morning at 10.
