WHO PAYS THE COSTS? Hon, Mr. H. E. Pollock, X., instructed by Mr. A. G. Jackson, of Mesurs: Johnson, Stokes and Master, appeared before their Honours the Chief Justice and the Pulsne Judge sitting as a Full Court in Appellito Jurisdiction, to argue on the subject of the payment of the costs in the case of Long Kas varies Ng Wai,

In this case the plaintiff stated that on his re. turn to Hongkong he was surprised to receive a demand from the defendant for the repayment of the sum of Sio,cos advanced on a mortgage of plaintiff's property, such mortgage having been executed during the plaintiff's absence in

Judgment had been given in this case. for the plaintiff, but costs had been ordered to be paid by the plaintiff, as it was held that both parties bad been swindled by some 'party' or parties acknown, and the delƐadant was the most unfortunate.
Mr. Pollack argued that as there was ne sligence on the part of the defendants in not making sufficient investigation before acreply g the mortgage and-making the advance, therefore that the defendant should pay the
costs.
Mrr Pollock continued his arguments up to and after the tiffio adjournment and sub. sequently quoted at some length authorities to show why the plaintiff should not pay the costs, his point being that there was not; and could
not be, any neglect or misconduct on the part of the plaintiff, and therefore the Court had no discretion to deprive the
successful suitor of his costs.
Mr. Slada then took up the argument and said that the dele, ce held that the proceeds of the mortgage were received by and on behalf of the plaintiff and for his benefic, and for the benefit of his firm, or of the frn is which he had been a partner before, his point being that the signatory to the mortgage was the plain tiff's own son--which the plaintiff had denied and was acting on his behalf and with his connivance.

3. It became apparent early in the year that
would be necessary, but it was not until a special Medical Officer for the Railway October that such an officer became available. From 4th May Dr. H. Macfarlane acted as Railway Medical Oficer, and did what was essential at the camps, in addition to his own duties in: Kowloon. On 4th October, Dr. J.W. Hartley arrived in the Colony, and assumed the office. Da 7th December he was trunk ferred to other duty, and I was appointed to the post. Op 24th August Mr. Chan Hin Fan, a licentiate" of the Hongkong College of Medicine, was appointed to be Chinese Medi cal Officer resident at the Tunnel. North Face camp and on the 14th November the Railway authorities were granted permission to avail themselves of the Government Dispensary under Mr. Lau Lai, Chinese Medical Officer at Tai-po; for-treatment of bative employées on the section of the line near Tai-po,
4. A medical office and dispensary have bees extablished at Tunnel South Face, and also at Tunael North Face, it is proposed to erect a small hospital at each of these camps. These hospitals will be centres for dealing with out patients, and for the rendering of first aid in, serious emergency through accident or otherwise, and will contain ose or two wards for be in patient of Chinese employees who may require special attention in hospital with out the necessity of skilled nursing.

European employées are treated by the medical officer in their own quarters for brief iloises, or for conditions not requiring train ed nursing; for more serious ailments they are transferred to the Government Civil Hospital.
