Interest, and Rs. 150 per mensemi, promised to be paid under an agreement, dated 5th November. Service of summons having been proved on the defendant in Jail, evidedop way: recorded. Defendant was not present in Court. The evidence showed that the monies were fent to Gibbons and Co. in three sums, Perret, was the sole proprietor of Gibbons; the, fium's business was stated to be manufacturers, merchants' agents.

Mr. Justice Davari Ti is all due to exorbitant rates of interest from the debtors, This morning I had a case in which the rate, of interest por annum amounted to nearly three quarters of the principal lent. So far as I am concerned, I am going to set my face against it.

Judge remarked that as there was no consider ation on the part of the „pixintiffs for the Rs. 150 per meniém, promised to be paid by the defendant, he should disallow the sum; and pass an "exparte" decree in favour of the plaintiffs, with the interest, and costs,
