FIRST NEWS OF ANY COLLISION being alleged against the Indus, was received In opening the case on behalf of the defend-

The Captain of the Indus would be able to lay down the course of his ship showing they passed as usual inside of Pedro Blanco, and at the time the collision, was alleged to have occured were some 15 to 20 miles beyond the Island. With regard to the question of current, Captain Douglas had already informed the Court there might have been one running at about two knots, but the witnesses for; the defence

The officers of the Inder would inaintain that not only had they no current against thèm on the day in question, but that they had one in their favour, and it was perfectly clear that such was the case considering the time taken between the Lammocks and Breaker Point, It was impossible for a ship on her course know what current she had until land or other means of ascertaining her position was sighted. Supposing a ship started from Breaker Point at night at a certain time and proceeded along the coast at a definite speed without passing any lighthouses she could not tell until ascertaining her position what cur rent was running either with or against her. In cross-examination, witness said he slept like a sailor "always on the alert and ready for anything." According to the log. while passing Breaker Point he was going at 15 knots, and at to p.m. it was reduced to 13 knots and from 5 to 6 o'clock they slowed down to 10 knots, while at seven o'clock the speed was further reduced to eight knots. The Indus passed seven miles to the north of Fedro Blanco, and it depended on circumstances whether they slowed down on arriving at Breaker Paint in the morning of the day named he noticed two steamers following behind his ship, one being a fairly large boat and the other a coaster. They did not have white hulls and black funnels.

Further evidence was then taken and the case was again adjourned till Friday next.

Arthur Dommock, of H.M.5. Albion, to-day was sentenced to serve six weeks in goal for larceny and 14 days for assault. A shopkeeper had his show case open displaying some goods

The proprietor naturally objected to this method of disposing of his goods, and together with one of his coolies, attempted to force the return of the stolen article.
