IMPORTANT PROSECUTIONS," After a lapse of several weeks the Public Works Department has taken Magisterial pro- ceedings in' connection with the collapse, of Nos. 33 and 34, Cochrane Street, and this morn ing Chan Jan Chigung, the owner of the pro perty, and Pun Wo,, trading as. Wo Ki, the contractor, attended before Mr. Hallifax at the Police Court to answer various charges relating to the erection of the premises.

It had been expected that little official business would be accomplished on the open-- ing day and the prompt decision as to Admiral Howison came somewhat as a surprise..

Prior to the court's convening a goodsized crowd assembled at the Washington aty.yard, where the court meets, to witness the coming of the prominent officers who were to take part in the proceedings.

They came un-uniformed and unheralded, and till the full dress uniforms had been donned at quarters inside the yard for the actual sessions of the court, there was little to land dramatic interest to the occasion.

Admiral Dewey and Admiral Schley natural- ly were the premier figures in popular interess, The latter had about bitrar distinguished party of counsel, including Jere-Wilson, Attorney General Raynor, of Maryland,, and Captain James Parker, with Mr. Tuague, acting as advisory counsel. The German naval attache, Captain Rebour-Paschwitz, occupied one of the seats in the public area and the number of wives of naval fficers present was noteworthy. A salute of seventeen guns, in honour of the admiral of the navy, marked the opening of the proceedings at 4 o'clock. In concluding this testimony, the question arose whether Admiral Howison would join issue with the statements made by the witnesses or would rest on his privilege to withhold any answer until he chose to submit, The admimi met the issue by turning at once to Admiral Dewey and announcing that he would make a written rejoinder to the state ments of the three witnesses. The rejoinder ho prepared very speedily. While conceding the accuracy of some points in the evidence It threw considerable doubt on other points and disclaimed any recollection of the talka. said to have taken place on the tranantiantic steamer.

It was not sufficient however, to counteract the very direct testmony given by the thres witnesses and, moreover, the admiral himself, in concluding his statement, indicated plainly that he had no desire to remain on the court and was there simply in obediace to orders. He appealed to his associates on the court to decide all doubtful questions as to his eligibility. in favour of Admiral Schley.

Before submitting the challenge, to the determination of the court, Raynor cross- examined Admiral Howison very minutely na to his personal segments toward Admiral Sampson and Admiral Schley and developed that Admiral Howison had expressed certain. definite convictions made as, to ¡Admimi

Sampson's retention of authority and the reponsibility even while he was absent temporarily from the fleet at Santiago. The challenge then was submitted to the court, which, under the circumstances, was narrowed down to Admiral Dewey and Rear Admiral Benham to pass upon. After hardly, mora than fifteen minutes spent in cetirement to, the consultation room of the court Admiral Dewey announced that the court sustained the challenge and that Admiral Howison would be excused from farther attendance. The decision. came so quickly and unexpectedly that it sent n flutter of agitation through the court room. There was a buzz of animated, comment, and Admiral Schley exchanged looks of satisfaction with his counsel. Admiral Dowey at once closed the proceedings of the day by announcing that the court would adjoum indefinitely!ants! the navy department named an officer, to succeed Admiral Hewison.
