In one count it would be alleged that the knife was held in the murderer's right hand, in another that it was held in his left hand, and so on. It was one thing to require that the accused should know what he was charged with, it was quite another to require a number of irrelevent details to be insened in the Indict ment. Even in the present day some of our indictments might, with advantage, be greatly Abbreviated, and no doubt this will be done when our law becomes codified.

CONCLUSION,

It seems down to 1736 about two-thirds of the condemned were actually brought to the scaffold. From 1750 to 1772 the proportion sinks to about one-half, between 1802 and 1808 it is no more than one eighth. Then the pre- rogative of the Crown was used to lessen the hardship of the law. Again it was a capital offence lo steal from a dwelling house an article of the value of forty shillings. Sir Samuel Romilly tells how a jury, not wishing to hang a wretched woman who confessed to stealing } 45 from a dwelling proved she had only stolen. 39 shillings.
