The Attorney-General, in explaining the facts of the case, said that the prisoner was charged with masslingbter and not murder. The old woman awoke and there was a cry of "Stop thief," Deceased ran about 100 yards and then dropped the things and the old woman recovered them. The prisoner, with three other men, pursued him, pristner being armed with a bamboe, about 6 ft. in length. The four men chased him for about 300 yards before they overtook him. The witnesses aid that deceased was beaten by the men; some used thele fists and the others ased poles. Very shortly afterwards two of the men who bad not poles went away leaving the other two men, who thought that be bad not quite enough. Deceased got op and ran but they went after atm, knocked him down and beat him again and then went away. Deceased got up and staggered along til he had gone po yards when he sat down and leaned against embankment, and in a few minutes he died. Althugh he was appparently in goed health he had a very large spleen. There were witnesses to this and a report was made very shortly afterwards to the Yau-ma-ti Police Station. Sergeant Coutta and Detective U Po were sent to the scene and found deceased, who was then dead. The body was removed to the mortuary and Dr. Thomson, who made a post mortem | examination, said that death was caused by rupture of the spleen.

Evidence was taken and the case was ad- fauined till zo a.m, to-morrow,
