There is another feature ofthis case worth considering, and it is connected with this Colony. The Chinese Government cannot with any shadow of consistency demand of Great Britain the cessation of imports of opium from India into China on the ground of the noxiousness of the drug while it allows both its production and consumption to be carried on in such a vast scale on Chinese territory. We will give a few of the figures presented by Mr. OLHMER as regards these facts: In the Szechwan province the annual production has been estimated as high as 150,000 piculs." SUPREME COURT~
IN BANKRUPTCY.
(Before Acting Chief Justice Russell).
FRASER-SMITH 7. CROKER.
This was an interpleader suit, in which Mr. R. Fraser Smith sought to recover from the Official Assignee of the bankrupt estate of J. W. Croker & Co, the sum of $993, advanced as a lien on certain engines hypothecated to the Chartered Bank of India, Australia and China, Mr. John Francis Webber appeared for the plaintiff, 'Mr. Wilson (of Messrs. Wotton & Deacon) for the Official Assignee, and Mr. Creasy Ewens for the ImperialMaritime Customs.
The Judge: Did you seire them under the writ of execution a clear fourteen days before the liquidation?
Mr. Webber:--We were not allowed to sell by the Official. Assignee. The goods were handed over to the Customs by arrangement.
The Judger-Assuming for a moment that you seized them under a writ of execution-if these goods were not sold at feast fourteen days previous to Croker's being declared a bankrupt you have no title. In order to invalidate the claim of the Official Assignee you must have actually seized and sold the goods fourteen clear days before he demands them on behalf of the
other creditors.
Mr. Webber: They were not sold by the Official Assignee-they were handed over at the meeting of cfeditors to the Customs for a fixed sum,
The Judge —On this point the law in clear, On the 25th June you seized the goods and between that time and the date of Croker's adjudicatiq as a bankeropt there are only ten days. It is evident, therefore, that by section 14 of the Ordinance you have no legal status.
Mr. Webber:-My contention is that they had noright to the goods beyond the amount they the Customs knew it, to the extent of $993, but had paid. We had a lien on these engines, and by the action of the Official Assignee we were prevented from selling the goods and realising
That amount.
The Judge then read the section, and added: -Now you see, even if you had sold the goods immediately after seizure on the 25th Junë, and had pocketed the proceeds, the other creditors. would be entitled, after allowing for expenses, to recover the remainder from you. that as against the money paid by the Customs Mr. Webber:-Yes, if we had sold. It spoke favorably of the financial position of the colony, mentioned that Mr. frice was going to retire, referred to the increased pay of the Polles Force and Gaol staff. and admitted the necessity for new buildings for the Post Office, Supreme Court, Harbour Office. &c. The probable share of the Government in connection with the Praya Extension - was estimated at $793,000, the total cost being estimated at $9,784.777. Reference was made to the value of the Tytam Waterworks as an asset for possible loans, and to the growing importance of the Port. The erection of a new Gaol was recommended, the cost being estimated! at $370,000, if the present gaol sold for $50,000 A hint was given that Government servants woulki shortly have their salaries raised, vents having become higher. In connection with the Gap Rock it was suggested that a tax of half-n-cent për ton be fixed, the annual income being estimated nt $30,000. The licenses on cargo-boats were recommended to be abandoned, and a reduction of 14 per cent, made on the asséssed rates. The claims of the Imperial Institute were then dragged in and pleaded for as being a sort of sample shop for the Colonies. In conclusion His Excel- lency promised to prepare another message-a review of the year, in which he will refer to prospective measures.

A War Office despatch explaining the delay with reference to the supply of the armament for the defence of the Straits Settlements and this Colony was read. It was dated August, and said that although part of it was despatched last year, was no stay of execution on the part of the Court.

The Judge: It does not matter what letters you have unless you have a mortgage you have no lien.
Mr. Wilson asked for costs on behalf of the Official Assignee.
Mr. Webber opposed it. This was not a case where costs ought to be asked.
The Judge Docs the Official Assignee ask

Mr. A. G. Wise (Official Assignee)--No! no! Mr. Wilson-Yes, my lord; I ask for costs for the Official Assignee.
